Settlements with President Trump and Allies

We filed FOIA requests to shed light on growing ethical and legal concerns that President Trump and former senior aides are seeking taxpayer funds to compensate themselves for past federal investigations into them.

What We Sought

President Trump is reportedly attempting to obtain $230 million in compensation from the Department of Justice for federal cases brought against him  while he serves as President. Trump filed complaints in 2023 and 2024 seeking damages in relation to the F.B.I. and special counsel investigation into Russian election tampering, as well as the F.B.I. search of Mar-a-Lago for classified documents.

Shortly after reporting broke about Trump’s $230 million request, new reporting indicates that the administration has been in talks to resolve cases brought by former national security adviser, Michael Flynn, and by former senior White House lawyer Stefan Passantino–with Flynn seeking $50 million for an alleged wrongful prosecution.

The matter raises grave ethical concerns both for President Trump personally and for Deputy Attorney General Todd Blanche, who previously served as Trump’s personal defense attorney and may now be involved in reviewing or approving the President’s claim. The revelations regarding Flynn’s and Passantino’s settlement discussions continue to raise concerns about potential political interference and the granting of relief to individuals who are considered “friends” of the White House.

Public transparency is essential to shed light on these stunning and unprecedented potential breaches of ethical safeguards. We submitted FOIA requests seeking records of payments related to these potential settlements, as well as communications relating to the claims of liability.
