Washington, DC – Today, Democracy Forward filed a lawsuit against the U.S. Department of Justice (DOJ) demanding the release of public records related to Acting (and nominee for) U.S. Attorney for the District of Columbia Ed Martin’s conduct and communications while serving in one of the nation’s most powerful federal prosecutor roles.

The lawsuit seeks to compel DOJ to comply with its legal obligations under the Freedom of Information Act (FOIA), following its failure to respond to record requests for Martin’s emails, text messages, calendar entries, and visitor logs—key information that could shed light on serious concerns about Martin’s potentially politically-motivated and improper conduct while serving in his acting capacity. DOJ has failed to release a single record in response to Democracy Forward’s requests.

The suit also highlights Martin’s apparent use of personal social media and messaging platforms to conduct official business, raising additional concerns regarding transparency and record-keeping.

“U.S. Attorneys are obligated to serve the nation and uphold the rule of law, without regard to personal or ideological agenda. Ed Martin’s record to date raises urgent concerns about impartiality and abuse of power,” said Skye Perryman, President and CEO of Democracy Forward. “The public deserves transparency from those in powerful roles—especially when they are being considered for permanent appointments. The Department of Justice cannot ignore its responsibility to provide access to these public records.”

Martin, who has been nominated for permanent appointment, has drawn scrutiny for describing himself as “Trump’s lawyer,” promoting his support for January 6 rioters, dismissing career prosecutors, and opening investigations into members of Congress for their public statements.
