Tennessee — Today, the U.S. District Court in the Eastern District of Kentucky struck down a Title IX regulation that strengthened protections for students, including student survivors, pregnant and parenting students, and LGBTQI+ students, from discrimination in schools. Today’s decision undermines the protections of Title IX by blocking the rule nationwide.

“All students across the country deserve an education and schools free from discrimination,” said Kaitlyn Golden, Senior Counsel at Democracy Forward. “Today’s ruling sows unnecessary confusion about Title IX Protections for students. We must continue to uplift and defend the protections that federal laws, like Title IX, afford, for students to be free from discrimination and harassment.” 

The rule blocked in today’s decision would have provided important clarity regarding the rights of all students, including the right of students to use school facilities – such as restrooms and locker rooms – that align with their gender identity.
