Washington, D.C. – Skye Perryman, President & CEO of Democracy Forward, issued the following statement regarding the Supreme Court’s decision in Kennedy (formerly Becerra) v. Braidwood (2025): 

“We welcome the U.S. Supreme Court’s decision today to uphold the preventative care requirements Congress mandated in the Affordable Care Act (ACA). The Court categorically and rightfully rejected baseless theories and efforts to contort the text of the ACA and our Constitution in a manner that would have threatened millions of people’s health care – from cancer screenings to contraception. Democracy Forward was honored to defend this essential care provided for by the ACA and filed a friend-of-the-court brief in support of this decision on behalf of 35 of the nation’s leading medical organizations, who represent millions of patients with serious health conditions and hundreds of thousands of health care professionals that rely on and provide life-saving and sustaining preventive care.

“A win in this case, however, should not overshadow our continued concern that anti-science special interests represented by far-right legal organizations are filing frivolous cases in handpicked courts that put the health and wellbeing of millions of Americans at risk. The American people should not have to worry day to day about whether they will be able to get the health care they are entitled to because of efforts that are designed to stoke fear across the nation. Like last term – when the Court ruled 9-0 to reverse the U.S. Court of Appeals for the Fifth Circuit’s ruling, made at the behest of far-right, anti-science interests that jeopardized the American people’s access to FDA-approved mifepristone – a majority of justices yet again have had to reverse a ruling that would have jeopardized care for millions.

We will also hold the current administration accountable should it seek to promote junk science and political ideology at the expense of the American people.”
