Lawyers Will “Find a Way or Make One” in Defending Constitutional Rights, Democracy Forward CEO Says
Washington D.C. — Today, a majority of justices of the U.S. Supreme Court issued a ruling that limited the scope of lower court injunctions that they had issued to protect the express constitutional rights of citizens of this country. The Court’s decision limits injunctions only “to the extent that the injunctions are broader than necessary to provide complete relief to each plaintiff with standing to sue.”
The case arises from the Trump-Vance administration’s attempt – which the Department of Justice did not seek a ruling on the merits of – to eliminate birthright citizenship, which is expressly provided in the Fourteenth Amendment of the U.S. Constitution.
“Today’s decision is a disappointment for all who are looking to the U.S. Supreme Court to protect the Constitution’s checks and balances against an executive branch that, on the first day of taking office, sought to eliminate the Constitution’s express protection for citizens of this nation. While disappointing and yet another obstacle to the ability of the American people to swiftly protect their Constitutional rights, the Court limited its decision and a number of pathways remain for individuals to obtain relief from the courts,” said Skye Perryman, President and CEO of Democracy Forward. “Our promise to the American people is that we will continue to use all legal tools to defend the rights of people and our nation’s Constitution.
