Georgia Moved to Intervene to Defend Trump Admin’s Illegal Approval of the State’s Plan to Eliminate Its Insurance Marketplace

By Allowing GA to Eliminate Use of Healthcare.gov, Unlawful Waiver Will Result in Enrollment Decreases of up to 100k, Direct Georgians to Junk Insurance Plans, and Raise Premiums

State’s Motion to Intervene Filed in Lawsuit Brought by Planned Parenthood Southeast and Feminist Women’s Health Center

Washington, D.C. — The State of Georgia moved to intervene in a lawsuit challenging the Trump administration’s unlawful approval of the state’s plan to block Georgia residents’ access to Healthcare.gov and ignore essential Affordable Care Act (ACA) requirements. On Friday, the court approved the motion to intervene. The lawsuit, filed in January 2021, was brought by Planned Parenthood Southeast and Feminist Women’s Health Center, which are represented by Democracy Forward and Paul, Weiss, Rifkind, Wharton & Garrison LLP.

The groups issued the following joint statement in response to Georgia’s motion to intervene:

“The State of Georgia is doubling down and seeking to defend the Trump administration’s unlawful approval of the state’s destructive health insurance plan. Its efforts would damage Georgia’s health insurance market, force Georgians to shop for insurance through private brokers and insurance companies, lead more residents to enroll in junk plans, and increase premiums. We brought our lawsuit to hold government officials accountable for unlawfully sabotaging the Affordable Care Act, and we’ll continue our fight to protect Georgians’ access to high-quality, affordable health care.

“As we told the Trump administration: we’ll see you in court.”
